Under Art. 128 TFEU, euro banknotes issued by the via mail or e-mail (fs-bankrecht@fau.de) ECB and the NCBs are the only banknotes which have status as „legal tender“ in the Union. Even almost 20 years after the introduction of the euro as Single European Currency it remains unclear whether Art. 128 TFEU enshrines an autonomous concept of legal tender with regard to the Euro or whether the provision merely refers to pre-existing concepts of legal tender
in the national laws of the Member States. This is all the more remarkable as the matter is of significant practical importance in private as well as in public law. In order to lay the basis for a potentially genuine European notion of the Euro as legal tender, the conference will scrutinize national traditions in monetary
law of selected countries inside and outside the Euro
